Declaration of Compliance with The Pensions Regulator

Once you have created your auto-enrolment pension scheme and enrolled your staff, you must inform The Pensions Regulator (TPR) that you have met your legal employer duties. This is done by submitting a Declaration of Compliance.

  • Your duties start date is the exact day your first member of staff starts working for you, marking when legal automatic enrolment duties begin

You must submit this declaration within 5 months of your duties' start date. Failure to complete the declaration on time may result in penalties or fines.

Step 1:  Go to The Pensions Regulator’s Portal.

You can access the portal here.
Before starting, make sure you have the following information ready:

  • PAYE reference number
  • Letter code from The Pensions Regulator
  • The letter code is normally sent by post after you register as an employer with HMRC.
  • If you don’t have your letter code, you can find it here
  • Employer contact details
  • Pension scheme details
  • Number of employees and their categories

Step 2: Sign in or create an account

You can complete the declaration by continuing as a guest or creating an account.

Creating an account is advisable as it allows you to save your progress, manage multiple declarations, and access your submission later.

Step 3: Enter your PAYE reference and letter code

Step 4: Start your declaration

Provide the following information:

  • Your relationship to the employer (typically Director, business owner, payroll provider, or accountant)
  • Employer contact details
  • Employer name and address
  • PAYE scheme details (PAYE reference number)

Step 5: Enter workplace pension scheme information

  • Pension scheme name
  • Pension provider (e.g., NEST, Penfold Scheme, Smart Pension, The People’s Pension)
  • Pension Scheme Registry number (PSR) and Employer Pension Scheme Reference (EPSR)
  • Type of scheme: Occupational
  • The date the pension scheme became active

Step 6: Enter auto-enrolment duties information

  • Duties start date: Your duties start date is the exact day your first member of staff starts working for you, marking when legal automatic enrolment duties begin
  • Postponement: Employers are allowed to postpone auto-enrolment for up to 3 months. If you have postponed the enrolment, you must provide this date while completing the declaration of compliance.

Step 7: Enter the following staff details on the duties start date.

  • Total number of staff
  • Number already in a pension scheme
  • Number automatically enrolled
  • Number not eligible for auto-enrolment
